Under N.D.C.C. §§ 27-20-47(b)(b) and 27-20-48.1(1), the court may appoint “a fit and willing relative or other appropriate individual” as the child’s legal guardian. “Fit and willing relative or other appropriate individual” is defined in N.D.C.C. § 28-20-02(9) as “a relative or other individual who has been determined, after consideration of an assessment that includes a criminal history record investigation under chap. 50-11.3, to be a qualified person under chapter 30.1-27, and who consents in writing to act as a legal guardian.”
